LOWRY & REED: TERMS OF SERVICE AND CONDITIONS OF SALE

Welcome to Lowry & Reed. We understand that collecting rare, high-end lamps and early 20th-century decorative arts requires a high level of trust. By accessing our site or purchasing our pieces, you agree to be bound by the following terms, which are designed to protect both the historical integrity of our inventory and your investment.

GENERAL CONDITIONS & PRODUCT INFORMATION

Antiques: Most items offered in our gallery are between 80 and 120+ years old. By purchasing, you acknowledge that these items will naturally show signs of age, history, and wear.

Accuracy of Display: We make every effort to display colors, patinas, and textures accurately in our photography. However, we cannot guarantee that your monitor's display of any color will be completely accurate.

Right to Refuse Service: We reserve the right to refuse service to anyone for any reason at any time.

PRICING, INVENTORY & AVAILABILITY

One-of-a-Kind Inventory: Our collection consists of rare, one-of-a-kind antiques. We typically hold only one (1) of each item listed on this site.

Real-Time Availability: While we make every effort to update our online inventory in real-time, there are occasions—such as during live antique shows or gallery events—where an item may sell in person before the website reflects its unavailability. If this happens, your order will be promptly cancelled, and a full refund will be immediately credited back to your original payment method.

Pricing Errors: If a product is listed at an incorrect price due to a typographical error, we reserve the right to cancel any orders placed for the product.

PAYMENT METHODS & ORDER PROCESSING

Standard Online Checkout: For select items, we offer a direct option through our secure online checkout, accepting major credit cards and standard digital payment methods.

High-Value Acquisitions & Inquiries: Due to the rarity and significant value of our premier inventory, many pieces are available strictly by inquiry. By utilizing the inquiry option, you are initiating a private consultation. If you choose to proceed with an acquisition following this consultation, we will issue a formal, direct invoice.

Accepted Methods for Invoiced Sales: For all privately invoiced transactions, we strictly require payment via direct bank wire transfer or certified check.

Clearing and Shipment: To protect all parties, ownership of the item does not transfer, and the item will not be packed or shipped, until all funds have fully cleared and settled into our accounts. For checks, please allow adequate time for bank processing and clearance before dispatch.

SHIPPING, HANDLING & INSURANCE

Fully Insured Transit: Every item we sell includes fully insured shipping to protect your investment from the moment it leaves our gallery until it arrives at your door.

Trusted Carriers & Professional Packing: Given the extreme fragility of early 20th-century glass and antique lighting, each piece is meticulously packed using specialized materials. We utilize a network of trusted carriers (UPS, FedEx, or specialized "white-glove" delivery) and reserve the right to select the best option for your specific piece. Please allow adequate time for professional packing before dispatch.

Delivery & Signature: Due to the high value of our items, a direct adult signature will be required upon delivery.

RETURNS & REFUNDS POLICY

The 7-Day Inspection Period: You have seven (7) calendar days to inspect the piece. This 7-day period begins on the exact day the item is received by the buyer, whether it is picked up in person or officially recorded as delivered by the shipping carrier. If you are not completely satisfied, notify us in writing within this window to request a Return Merchandise Authorization (RMA).

Condition of Returned Items: To be eligible for a preference refund, it must be the exact, original item purchased and returned in the identical, unaltered condition in which it was received. All components—including original finials, heat caps, sockets, glass, and bases—must perfectly match our comprehensive archival photographs of the item to qualify for a refund.

Return Shipping: Returns must be professionally packed to the exact same standard in which they were received, fully insured for the original purchase price, and shipped at the buyer's expense. Once safely received and verified, a refund for the purchase price (minus original shipping charges) will be issued within seven (7) business days.

Transit Damage: If an item arrives damaged from the shipping carrier, you must retain all packing materials and notify us within 24 hours of delivery with clear photographic evidence so we can file an insurance claim on your behalf.

With over 35 years of rigorous, hands-on experience identifying, sourcing, and authenticating early 20th-century decorative arts, we want you to feel completely secure in your acquisitions.

The Lowry & Reed Guarantee: We guarantee the authenticity and attribution of every piece sold by Lowry & Reed to the original purchaser for a period of two (2) years from the date of purchase. This guarantee is non-transferable and applies solely to the individual or entity invoiced at the time of sale.

Based on Prevailing Scholarship: Our attributions are made with meticulous care, utilizing extensive physical inspection, historical documentation, and the prevailing expert consensus at the time of sale. The study of early 20th-century lighting is complex and continually evolving. Because production methods varied immensely—for instance, some original shades were never signed, earlier examples often feature micro tags rather than prominent logos, and specific hardware like acid-etched copper caps require highly specialized knowledge to evaluate—our guarantee remains valid provided there is no universally recognized shift in academic or expert consensus regarding the maker or era during your two-year guarantee period.

Archival Documentation and Condition: We deeply respect the history of these rare pieces. To protect both our clients and the historical integrity of the art, we maintain a comprehensive, high-resolution photographic archive of every item we sell. In the event a piece is returned under this guarantee, it must be the exact, original item purchased and in the identical condition as when it left our gallery. The returned piece—including all specific hardware, bases, and shades—must perfectly match our original archival photographs to qualify for a refund.

Process for Dispute: In the highly unlikely event that the authenticity of a piece is called into question during the two-year period, we ask the original purchaser to simply notify Lowry & Reed in writing. To invoke this guarantee and initiate a return for a full refund, the purchaser must provide written reports from two mutually agreed-upon, independent, and recognized authorities in early 20th-century decorative arts stating that the item is a forgery or has been misattributed.

Disclosed Reproduction Components: Transparency is paramount to our gallery. Due to the modular nature of early 20th-century lighting, certain original hardware elements may have been separated over the last century. If an item is paired with a reproduction component—such as a specific cap, finial, or base—we will explicitly state this in the item's individual listing. Any component disclosed as a reproduction is sold strictly "as is" and is expressly excluded from the authenticity guarantee outlined in this section.

Exclusions: This guarantee is limited to the authenticity and maker attribution of the piece. It does not cover eventual wear, historical restorations standard for antiques of this era, or changes in the item's condition after it has been securely delivered to you.

Intellectual Property: All content, photographs, and text on this site are the exclusive property of Lowry & Reed and are protected by copyright laws.

Privacy & Data Use: Your submission of personal information through our site or via our inquiry process is governed by our Privacy Policy. We are committed to protecting your personal data and handling it with the utmost confidentiality.

Modifications to Service & Prices: Prices for our items are subject to change without notice. We reserve the right at any time to modify or discontinue the website (or any part or content thereof) without prior notice.

Taxes & Duties: The buyer is solely responsible for any state sales tax, use tax, or international import duties associated with the purchase.

Disclaimer of Warranties & Limitation of Liability: Except for the specific 2-Year Authenticity Guarantee detailed in Section 6, all products are provided 'as is' and 'as available' for your use, without any representation, warranties, or conditions of any kind, either express or implied. In no case shall our business be liable for any injury, loss, claim, or any direct, indirect, or incidental damages arising from your use of the site or products.

Indemnification: You agree to indemnify, defend, and hold harmless Lowry & Reed, our partners, agents, contractors, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service.

Severability: In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida.
